Regulatory statement 122: Implementation of additional plastics limits to PAS100/PAS110 materials

This regulatory statement (RS) is valid until December 2026 by which time it will be reviewed. You should check back at that time to ensure the RS is still valid.

NRW can withdraw or amend this RS before the review date if we consider it necessary. This includes where the activities that this RS relates to have not changed.

Regulatory Statement

This RS applies to the production, storage and use of certified PAS100 compost or PAS110 digestate, that do not meet the plastics limit set out within NRW’s adapted end of waste guidance for Compost and for Anaerobic Digestate (adapted for use in Wales from the Environment Agency’s Resource Frameworks for compost and digestate).

Conditions you must comply with

You must:

  • Comply with all other requirements of the applicable end of waste positions for compost and anaerobic digestate.
  • Ensure that the plastics limit does not exceed the limits set out in the BSI PAS100/110.
  • Comply with all requirements of BSI PAS100/PAS110 certification scheme as appropriate.
  • Review your plant and processes to work towards compliance with the applicable new plastics limits stated in the end of waste positions for compost and anaerobic digestate.
  • Keep records for 2 years to show that you have complied with this RS, and make those records available to NRW upon request.

Enforcement

This RS does not change your legal requirement to have an environmental permit for a waste operation when you use certified PAS100 compost or PAS110 digestate made from waste that does not meet the plastics limit set out within the applicable end of waste guidance.

However, NRW will not normally take enforcement action if you meet the requirements in this RS.

In addition, your activity must not cause (or be likely to cause) pollution of the environment or harm to human health, and must not:

  • cause a risk to water, air, soil, plants or animals
  • cause a nuisance through noise or odours
  • adversely affect the countryside or places of special interes
