Regulagtory Decision 071: Storing and drying waste wood before burning in a Part B co-incinerator
This Regulatory Decision (RD) will be reviewed when the regulations or the regulatory guidance is amended. You should check back periodically to ensure the RD is still valid.
NRW can withdraw or amend this RD before the review date if we consider it necessary. This includes where the activities that this RD relates to have not changed.
Regulatory Decision
This Regulatory Decision (RD) applies if you want to store and dry waste wood before burning as fuel in a standalone Part B co-incinerator. For more information see Schedule 1, Section 5.1, Part B of the Environmental Permitting (England and Wales) Regulations 2016.
Conditions you must comply with
You must meet all these conditions to follow this RD.
You must:
- Hold a 5.1 Part B permit for the burning of waste wood issued by the local authority or Natural Resources Wales
- Only store and dry untreated waste wood which is to be used in the standalone Part B co-incinerator
- Only store the amount of waste wood necessary to operate the Part B co-incinerator
- Store the waste wood securely and in piles of no more than 4 metres high
You must not:
- Store more than 125 tonnes of waste wood at any one time
- Store any waste wood for more than one month
- Shred, chip or pre-treat the waste wood
- Carry out any other waste activity on site under a permit or waste exemption other than drying waste wood using heat from the co-incinerator
- You must make sure your activities do not endanger human health or the environment
Enforcement
This RD does not change your legal requirement to have an environmental permit for a waste operation when storing and drying waste wood before burning in a Part B co-incinerator.
However, NRW will not normally take enforcement action if you do not comply with the need for an environmental permit if you meet the requirements in this RD.
In addition, your activity must not cause (or be likely to cause) pollution of the environment or harm to human health, and must not:
- cause a risk to water, air, soil, plants or animals
- cause a nuisance through noise or odours
- adversely affect the countryside or places of special interest
