Regulatory Decision 114: pEPR producer data requirements
This Regulatory Decision (RD) is valid until 31 December 2026 by which time it will be reviewed. You should check back at that time to ensure the Regulatory Decision is still valid.
Natural Resources Wales (NRW) can withdraw or amend this RD before the review date if we consider it necessary. This includes where the activities that this RD relates to have not changed.
If you cannot comply with the conditions in this RD, you need to apply for an environmental permit.
Regulatory Decision
NRW will not take enforcement action against you if you do not collect and report data relating to nation of sale and self-managed organisational waste, for the specific periods, set out below.
1. 2024 nation of sale and self-managed organisation waste data
Data collected by producers under the Packaging Waste (Data Collection and Reporting) (Wales) Regulations 2023, for the period 1 January to 31 December 2024.
To be reported under the Producer Responsibility Obligations (Packaging and Packaging Waste) Regulations 2024, by 1 April 2025
2. 2025 nation of sale and self-managed organisation waste data
Data collected by producers under the Producer Responsibility Obligations (Packaging and Packaging Waste) Regulations 2024 for the period 1 January to 31 December 2025.
To be reported on or before 1 October 2025 and 1 April 2026.
Enforcement
This RD does not change or remove any of your legal obligations under the Producer Responsibility Obligations (Packaging and Packaging Waste) Regulations 2024.
However, NRW will not normally take enforcement action if you do not comply with the specific legal requirements set out in this RD.
In addition your activity must not cause (or be likely to cause) pollution of the environment or harm to human health, and must not:
- cause a risk to water, air, soil, plants or animals
- cause a nuisance through noise or odours
- adversely affect the countryside or places of special interest
